ATTENTION: USING PC FREEZE HELP SERVICES OR THIS WEBSITE INDICATES THAT YOU HAVE READ AND ACCEPT THESE TERMS AND ANY SUBSEQUENT AMENDMENTS. IF YOU DO NOT ACCEPT THESE TERMS, DO NOT USE OUR SERVICES OR THIS WEBSITE.

This User Agreement is by and between PC Freeze Help ("PC Freeze Help," "we," "our," or "us"), a U.S.-based independent technology support provider, and You, your assigns, agents, and contractors ("You"), and is made effective as of the date of electronic execution or the date You begin using our services, whichever is earlier. You also agree to be bound by these Terms for transactions entered into on Your behalf by anyone acting as Your agent, and for transactions entered into by anyone who uses Your inquiry or account. These Terms set forth the conditions of Your use of PC Freeze Help's website, software, and services.

1. The Service

PC Freeze Help provides independent, remote-only technology support and guidance for U.S.-based professionals and businesses. Services include interaction with a live support specialist who will attempt to improve the performance and stability of Your computer system. Services include, but are not limited to:

  • Diagnosing and resolving slow system performance, freezing, and unexpected restarts
  • Removing malware, adware, spyware, unwanted pop-ups, and other disruptive software
  • Optimizing Microsoft Windows operating systems and Microsoft Office applications for improved performance and security
  • Resolving driver conflicts, blue screen errors, and system stability issues
  • Addressing email and productivity tool connectivity and usability issues
  • Troubleshooting keyboard, touchpad, display, and input device software issues
  • Providing software update guidance and compatibility resolution
  • Answering "how to" questions related to Windows operating systems and common business applications
  • Providing hardware and software recommendations
  • Problem identification for hardware and network issues (remote identification only)

All services are delivered remotely via digital channels and approved remote connection tools only. PC Freeze Help does not provide on-site visits, physical repairs, or hardware replacement services.

Services are available only in English for customers located within the United States.

If Your operating system is no longer supported by its manufacturer, PC Freeze Help may be unable to support the device and will recommend an upgrade.

If a customer partially or fully undoes work completed by a PC Freeze Help technician, PC Freeze Help is not obligated to rework previously completed sessions without additional charge. If the same specific issue is requested on more than three (3) separate occasions, PC Freeze Help reserves the right to address the issue at its standard hourly rate or to decline service.

Customers must comply with all applicable laws. If PC Freeze Help believes that a crime has, may have, or will be committed, PC Freeze Help may, in its sole discretion, report relevant information to authorities and cooperate fully.

2. Availability of Service

Subject to these Terms, PC Freeze Help shall attempt to provide services Monday through Friday, 9:00 AM to 6:00 PM Eastern Time. You agree that services may be periodically inaccessible or inoperable for reasons including, without limitation: (1) equipment failures; (2) scheduled maintenance or repairs; (3) causes beyond the control of PC Freeze Help, including telecommunication or digital transmission failures, hostile network attacks, network congestion, acts of God, acts of nature, or national emergencies.

3. Eligibility & Business Use

Our services are designed strictly for professionals, business owners, and business entities located within the United States. By using our services, You represent that You are at least 18 years of age and are engaging the services for legitimate business or professional purposes. PC Freeze Help does not provide services to individual consumers for personal, household, or non-commercial use.

4. Fees

In consideration for PC Freeze Help providing its services, You agree to pay the applicable service fee. All fees are communicated to You prior to the commencement of any service session. PC Freeze Help reserves the right to update its fees at any time; updated fees will be reflected on the PC Freeze Help website, which You should review periodically.

Services are quoted and provided on a per-session or per-engagement basis unless a separate written agreement specifying alternate terms has been executed between You and PC Freeze Help.

5. Payment Method

You agree to provide a valid payment method to purchase service. Payment is required prior to or at the time of service delivery as communicated by your support specialist. PC Freeze Help accepts major credit and debit cards. You agree to provide true, current, accurate, and complete payment information.

6. Cancellation Policy

You may cancel or reschedule a scheduled session by contacting us at least two (2) hours in advance. All cancellation requests must be submitted in writing to support@pcfreezehelp.com and must include a reason for cancellation. If PC Freeze Help is unable to charge Your payment method for services rendered, PC Freeze Help may pursue all available remedies to obtain payment, including collection agency referral. PC Freeze Help is entitled to recover reasonable collection and attorney's fees incurred in connection with collecting unpaid amounts.

7. Refund Policy

Refunds will not be issued after services have been fully rendered. If You request a refund for services not yet rendered, an administrative processing fee equal to thirty (30) minutes of support time may apply.

If PC Freeze Help is unable to resolve a specific software problem within the agreed scope of the session, a partial or full refund may be issued at the sole discretion of PC Freeze Help. Any partial refund, if issued, will be calculated by subtracting the value of service hours provided at the standard rate from total customer payments for that session.

All refund requests must be submitted in writing to support@pcfreezehelp.com.

8. Your Cooperation

You agree that Your computer has a stable broadband internet connection sufficient to support a remote session. You agree to allow PC Freeze Help to temporarily view and control Your computer during a session. You agree to remain present at Your computer while PC Freeze Help is diagnosing, downloading, or resolving an issue.

For the most efficient service, You agree to allow PC Freeze Help to download applicable tools or software (which may include free or fee-based solutions) or remove harmful software to facilitate proper diagnosis or operation. While PC Freeze Help will attempt to obtain Your prior approval before making significant changes, You acknowledge that some modifications may be made in the course of service without individual prior approval for each step.

You agree to provide genuine operating system installation media or legitimately licensed software if PC Freeze Help determines such media is required to complete service.

Data Backup Responsibility: You are solely responsible for maintaining a complete backup of all data, software, and files on Your system prior to the commencement of any service session. PC Freeze Help is not liable for data loss or corruption that occurs during or after a service session.

9. Remote Access & User Consent

PC Freeze Help may use approved remote-access tools to view Your screen or control Your computer for the purpose of providing the requested service. Remote access will only be initiated with Your explicit verbal or written consent. You may terminate remote access at any time by closing the remote session tool on Your device or by requesting termination verbally.

You understand that PC Freeze Help may view files, settings, and system information on Your computer during a session. PC Freeze Help shall use commercially reasonable efforts to maintain the confidentiality of any information viewed during a session, except as required by law. PC Freeze Help agrees not to knowingly transmit to Your computer any virus, worm, Trojan horse, or other code designed to disrupt functionality.

10. Independent Provider & Third-Party Disclaimer

PC Freeze Help is an independent technology support provider. We are not affiliated with, endorsed by, sponsored by, or partnered with Microsoft, Apple, Google, Dell, HP, Norton, McAfee, or any other third-party brand or manufacturer. Any reference to third-party trademarks, brand names, or product names is for identification purposes only and does not imply any association with the respective owner. Assistance with third-party software or hardware does not constitute a partnership with the manufacturer or developer of those products.

PC Freeze Help does not guarantee that it will locate, diagnose, or resolve any or all problems, or eliminate all viruses, worms, spyware, or other malicious software. Technology is inherently unpredictable, and results may vary.

11. Use of Software & Downloaded Tools

If PC Freeze Help downloads or suggests that You download software tools to Your computer, such software is licensed to You or directly by the respective software vendor. Neither title nor intellectual property rights are transferred to You. You may not copy, transfer, sublicense, decompile, reverse engineer, disassemble, or otherwise convert such software.

PC Freeze Help may provide links to or suggest downloads of third-party software or resources. Such suggestions are provided solely as a convenience and do not constitute an endorsement, sponsorship, or recommendation of the third party or its products. PC Freeze Help has not reviewed all third-party software and is not responsible for its content, performance, or security. You use any third-party software at Your own risk, and PC Freeze Help shall not be liable for any damage or loss arising from such use.

The respective software vendors are directly and solely responsible for all warranties, liabilities, and customer service related to their software. PC Freeze Help disclaims all warranties and responsibilities related to vendor software.

12. Use of Website

PC Freeze Help authorizes You to view and use the materials on this website for Your personal or business informational purposes only. You may not modify, reproduce, publicly display, distribute, or otherwise use any content from this Site for any public or commercial purpose without express written permission from PC Freeze Help. The content on this Site is protected by copyright, trademark, and other applicable laws. Unauthorized use may violate those laws.

13. Trademarks & Service Marks

The PC Freeze Help name, logo, and associated marks are proprietary to PC Freeze Help. By making them available on this Site, PC Freeze Help is not granting You a license to use them. All other names, brands, and marks referenced on this Site may be the property of their respective owners.

14. User Submissions

Any material, information, or communication You provide to PC Freeze Help other than personally identifiable information (which is governed by the Privacy Policy) will be considered non-confidential. PC Freeze Help shall use commercially reasonable efforts to maintain the security of Your personally identifiable information; however, You submit such information at Your own risk.

By providing Your email address and/or phone number through the contact form or by telephone, You consent to receive communications from PC Freeze Help related to Your inquiry, including emails, calls, and text messages. Normal message and data rates may apply. You may opt out at any time by contacting support@pcfreezehelp.com.

You agree not to disguise Your identity, spoof headers, or impersonate any person or entity when communicating with PC Freeze Help.

15. Termination

This Agreement commences on the date You accept these Terms or begin receiving service from PC Freeze Help, whichever is earlier, and continues until the service engagement concludes or either party terminates it. PC Freeze Help, in its sole discretion, may terminate or restrict Your access to the Site or services for any reason, including if PC Freeze Help believes You have violated the letter or spirit of these Terms or any applicable law. PC Freeze Help shall not be liable to You or any third party as a result of such termination.

16. Force Majeure

PC Freeze Help's ability to provide services may be impaired by circumstances beyond its reasonable control, including road or traffic conditions, weather, natural disasters, power or internet outages, strikes, national emergencies, pandemics, or other causes. In such circumstances, PC Freeze Help may suspend or delay services without liability.

17. Disclaimer of Warranties

THE SERVICES, SOFTWARE, AND MATERIALS PROVIDED BY PC FREEZE HELP ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. PC FREEZE HELP DOES NOT WARRANT OR REPRESENT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY PARTICULAR ISSUE WILL BE PERMANENTLY RESOLVED. BECAUSE SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

18. Limitation of Liability

UNDER NO CIRCUMSTANCES SHALL PC FREEZE HELP OR ITS PERSONNEL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE SERVICES OR THIS WEBSITE, WHETHER SUCH CLAIM IS BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, EVEN IF PC FREEZE HELP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

WITHOUT LIMITING THE FOREGOING, PC FREEZE HELP'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL LOSSES, DAMAGES, AND CAUSES OF ACTION ARISING OUT OF YOUR USE OF THE SERVICES OR THIS SITE SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO PC FREEZE HELP FOR THE SPECIFIC SERVICE SESSION IN QUESTION.

SOME STATES OR OTHER JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU.

19. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law principles. The parties agree that the courts of Howard County, Maryland shall have jurisdiction over any dispute, claim, or cause of action arising out of or relating to these Terms.

Any dispute that cannot be resolved between the parties directly will be submitted to binding arbitration conducted in accordance with the then-current Commercial Arbitration Rules of the American Arbitration Association. Arbitration proceedings will be conducted in Howard County, Maryland. Any arbitration award rendered shall be final and conclusive upon the parties, and judgment may be entered in any court of competent jurisdiction. One (1) arbitrator shall be appointed for claims under $100,000; three (3) arbitrators for claims of $100,000 or more.

20. Entire Agreement

These Terms constitute the entire agreement between the parties concerning the subject matter herein and supersede all prior agreements and understandings. These Terms may be amended only by written agreement of both parties. Failure to enforce any provision of these Terms will not act as a waiver of that provision or any other right.

21. Notices

Notices to You may be made via email or regular mail to the contact information You have provided. PC Freeze Help may also provide notices of changes to these Terms by displaying notices on the Site. Notices to PC Freeze Help must be submitted in writing to support@pcfreezehelp.com.

22. Revisions

PC Freeze Help may make changes to these Terms, the Site, and its services at any time. You should visit this page periodically to review the then-current Terms, which are binding on You. Continued use of the Site or services after updated Terms are posted constitutes Your acceptance of the revised Terms.

23. Acceptance of Terms

You acknowledge that You have read and agree to be bound by these Terms. You represent that You have the legal authority to accept these Terms on behalf of Yourself or any party You represent. IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT USE THIS SITE OR OUR SERVICES.
